Jay 37,416 Posted November 15, 2021 Share Posted November 15, 2021 Here is Mike Matessino's explanation: "For AFM recordings made before July 3, 2005, NO reuse needs to be paid to the musicians at all, provided a) that it’s for a physical format release with a 5000 unit maximum, and b) that the musicians list is published, preferably in the packaging. For recordings made after that date, whatever the musicians were paid to record the score for the film has to be paid to them again, 100%. That’s why it’s called “reuse”. They were paid to play music for sync purposes, but an album is a new use. So, hypothetically, if 120 people were paid $360,000 to record the music for the film (musicians, orchestrators, copyists, at an average of $3K a person), then a label would have to pay that exact same amount to AFM in order to put out an expanded album. That makes it impossible to consider even before you get to licensing, publishing, production and manufacturing. The 2005 date was established in 2015 and applied to recordings going back 10 years prior, but unfortunately it was not a “sliding” date as it really should have been. The one I'm always advocating to get the specialty label treatment, Fried Green Tomatoes, I don't think has much missing but (a) the score album is long out of print, even digitally (only the songtrack album is streaming) and (b) it's super under-appreciated and deserves more attention because it's actually a very important milestone in Thomas Newman's career. As far as I know, it's his first orchestral (or at least primarily non-electronic) score for any film and the first that is recognizably his "signature" orchestral style. The two pre-'94 scores that are most in this signature orchestral style (as opposed to the more experimental electronic/exotic style) are Fried Green Tomatoes and Scent of a Woman, but the latter at least has the score album released digitally/streaming. It's a bit like everyone in the AFM put on their rosy-tinted glasses, looked at the deal they had, guaranteeing themselves full repayment for any post-2005 reuse, and no one put their 'logical' glasses on and wondered on how many occasions anyone would need to use their music enough to pay that fee. Newman's never been one or the other. While he does tend to be a session dump composer more than others, I've found that the more serious the film is, the more he tends to arrange the album. Although you do realise that even if he made an album with 15 tracks instead of 40, they'd play exactly the same, it's not like you can tell where your player is switching tracks. There isn't a single Newman score I can think of that I'd buy expanded (except Shawshank which we have), but then I'm not into his earlier (90s) work much. My favourite Newman score, The Horse Whisperer plays absolutely beautifully as an album, and I have no idea whatsoever what might be missing.
